1. External independency of Judges

The Judiciary has a self-governing body in Portugal, the High Council of the Judiciary (HCJ), which has jurisdiction upon civil judges. District court judges (first instance courts) are appointed by this body. However, only seven out of sixteen members of the HCJ are elected by their peers. The other nine are appointed by the President of the Republic or elected by the Parliament. The fact that less than half of the members of the HCJ are not elected by their peers reduces the HCJ’s independence towards the two referred political bodies that choose the remaining members.
