1.Introduction

In this essay, I seek to develop a few considerations regarding the contributions that new technologies can offer to the study of procedural law and to the improvement of the administration of justice, which is the subject of the aforementioned academic discipline. In order to better comprehend the ideas that follow, I believe it is necessary to first explicit the premises that inform this essay.

First, my starting point is that procedural law, as a ramification of public law responsible for regulating on of the State’s powers, must be orientated by a constant search for efficiency in its exercise. Since the State administers scarce resources gathered from its taxpayers, it must guarantee that the application of such resources is done in a justifiable manner. This will only be obtained if demonstrated that the exercise the State’s power has not created an even greater scarcity. With regards to the State’s jurisdictional power, these notions mean that this function of the State must be exercised in such a manner that its institutional mission to promote the application of law is done in a timely manner, which is tied to the other premises that I would like to point out.

In order to exercise the State’s jurisdiction in a timely manner, it is necessary to refrain from the practice of useless acts. It’s also worth noting that this role will only be adequately fulfilled if it is done in a predictable and justifiable form, this meaning that it is guided by rational standards that are capable of being universalized in order to preserve equality in the application of law. In this sense, as will be the subject of the following chapters, new technologies can provide valuable contributions to the accomplishment of these objectives. It’s worth noting that, when I refer to new technologies, I am speaking of, specially, the contributions that artificial intelligence may provide to Law based on the abilities that algorithms have to compare different situations and predict outcomes based upon statistical data.

That said as well as with the scope of this essay in mind, under the following item 2, I seek to point out how artificial intelligence can contribute to increase consensual solutions during the course of lawsuits, fulfilling the State’s mission of ensuring social concord as well as avoiding the long duration of a lawsuit.
